I, I'm so excited because truly, sometimes I don't know if it's a mic in front of me or if it's a crystal ball ah many, many times, but we spoke last week about NIL and the house settlement finally happening, the $2.8 billion, dollars billion, did I just make that up?

And what did I say about 45 minutes into the episode? I said, There's going some Title IX issues with this, and I'll be damned if a group of female athletes did not file an appeal pretty much immediately after the house settlement saying, hey, hey, y'all ain't following Title IX with this payout. So a group of eight female athletes, they're a mixture of track, soccer, and volleyball players that Their names are um public if you guys want to look them up.

Filed an appeal for the House vs. NCAA settlement. And the appeal is only challenging the back pay damages portion of the settlement. So nothing to do with the revenue share and all the other stuff. But just the back pay because they basically were like, um hello, y'all ain't following Title IX with the way that y'all are doing this back payout.

So they felt like the damages violate Title IX because female athletes would theoretically receive less money than the football and men's basketball players in damage payments and revenue sharing. And the attorney estimated it deprives female athletes of about $1.1 billion. dollars And in a statement to front office sports, she said paying out the money as proposed would be a massive error that would cause irreparable harm to women's sports.

um it The this settlement suggests that schools would have paid male athletes over 90% of their revenue over the past six years, as though Title IX did not apply. um If Nike wants to do that, that's their choice. If the school or a conference acting on the school's behalf tries to do that, they are violating the law. They can either pay the athletes proportionally or they can return all of the federal funds, but they cannot do both.

So we are back in litigation. It's only been five minutes. um But as we kind of were saying, there were going to be some issues as far as how this was really going to get split with the female athletes, even in the future with the revenue sharing how all that's going to work, but even now with the back pay. So everything is still up in the air with how this $2.8 billion dollars is going to be dispersed.
