00:00:33
Speaker
A Solarpreneur is a new breed of Solar Pro that is willing to do whatever it takes to achieve mastery and you are about to become one.
Technical Issues and Apologies
00:00:43
Speaker
Why I got audited by the IRS and the many mistakes I made.
00:00:47
Speaker
That's what we're going to be talking about in today's podcast.
00:00:49
Speaker
Welcome to the Solarpreneur Podcast.
00:00:51
Speaker
My name is Taylor Armstrong.
00:00:53
Speaker
We're here to make your life easier as a solar professional and help you close more deals, generate more leads and referrals, and have a much better time in the solar industry.
00:01:02
Speaker
Hope you're doing well.
00:01:03
Speaker
Thank you for making the Solarpreneur Podcast the first listen of every Tuesday and Friday.
00:01:09
Speaker
And speaking of every Friday, I want to apologize because we did not have an episode go out Friday.
00:01:15
Speaker
I promised an episode with Mr. Brian Leposki.
00:01:19
Speaker
He was going to be on talking about his CRM and how he built his company from the ground up after coming from SolarCity, but...
00:01:27
Speaker
went to upload the podcast and unfortunately we had an uploading error with our podcasting software and the entire time he talked it was dead silent not even crickets so figured you probably didn't want to just hear me talking and asking questions without a response so we did not get that podcast out
00:01:44
Speaker
We are working on a solution to possibly recover the file, but looks like we might have to go ahead and record a new one.
00:01:52
Speaker
So appreciate Brian and his patience and apologize again if you were expecting an episode last Friday, but didn't get one.
00:01:58
Speaker
I know heartbreaking, probably couldn't sleep, probably couldn't function.
00:02:02
Speaker
But life goes on.
00:02:03
Speaker
Learn from it.
00:02:04
Speaker
And my lesson was is to check beforehand if the file is actually uploaded.
00:02:09
Speaker
Because if I would have verified if the audio was good the day after we recorded it, probably would have made it a lot easier to recover and troubleshoot.
00:02:17
Speaker
But I didn't even notice it until we went to click upload.
00:02:20
Speaker
And the audio file was bad.
00:02:22
Speaker
Didn't work.
00:02:23
Speaker
So always double check things and look into things sooner rather than later.
00:02:27
Speaker
That's the lesson that I learned.
The IRS Audit Experience
00:02:29
Speaker
But speaking of lessons, let's jump into another important lesson, and that is how to not get audited.
00:02:36
Speaker
I guess I can't tell you any foolproof secret because I am being audited right now.
00:02:40
Speaker
But I'm just going to tell you my experience.
00:02:42
Speaker
This is my first time being audited.
00:02:44
Speaker
I hope and pray that none of you listening to the show have to go through this.
00:02:47
Speaker
It is a nightmare.
00:02:48
Speaker
It sucks.
00:02:49
Speaker
It's been taking time away from selling.
00:02:51
Speaker
It's been adding the stress levels.
00:02:53
Speaker
The IRS is showing up at my door.
00:02:55
Speaker
They're hunting me down.
00:02:56
Speaker
So whatever you do, don't...
00:02:59
Speaker
try if at all possible to not get audited and I'm gonna share with you some things that I could have done better that I think maybe would have prevented this but who knows maybe they just had my number no matter what I did so I'll tell you what happened to me about three four weeks ago and those of you that follow me on social media you may have seen this but I posted that I got a letter in the mail
00:03:18
Speaker
from the IRS.
00:03:20
Speaker
And I put a photo on my story, but the letter, it looked kind of sketchy, to be honest.
00:03:27
Speaker
It came in an envelope, had like six stamps on it, was handwritten.
00:03:31
Speaker
So my first thought was, did this come from like China or something?
00:03:36
Speaker
Why is it handwritten?
00:03:37
Speaker
And why is there like 20 stamps on it?
00:03:40
Speaker
Like it has to be a scam.
00:03:42
Speaker
So that was the first red flag that came up in my head.
00:03:44
Speaker
This is a scam.
00:03:45
Speaker
There's no way this is from the actual IRS.
00:03:48
Speaker
Then I open it up and it says, Dear Solarpreneurs, your employment tax return shown above has been selected for examination.
00:03:57
Speaker
And then it tells me it tells me to contact Min Pan.
00:04:02
Speaker
So that was another red flag.
00:04:04
Speaker
No offense, Min, but I don't know, just with all the stamps on it.
00:04:08
Speaker
And then with like a Vietnamese name, I'm just getting even more red flags.
00:04:12
Speaker
And then on top of all that, there were a few typos in it.
00:04:15
Speaker
And the letter tells me to call Min on September 15th.
00:04:21
Speaker
And you can reach me at the number shown above.
00:04:24
Speaker
So I'm just thinking, okay, if they're telling me to reach out to this person personally, like IRS, they wouldn't talk like that in the first person.
00:04:31
Speaker
Wouldn't they talk like, I don't know, official business?
00:04:34
Speaker
It looked like a personally typed out letter.
00:04:36
Speaker
So there were just a lot of red flags.
00:04:38
Speaker
I mean, after that, yeah, the pages did have like her ID number and, you know, the letter...
00:04:45
Speaker
3850 from the IRS.
00:04:47
Speaker
But I logged in to the IRS website.
00:04:50
Speaker
There was nothing.
00:04:51
Speaker
You can log into your IRS account.
00:04:54
Speaker
I think you have to create an account.
00:04:55
Speaker
So that was my second idea.
00:04:56
Speaker
I'm like, okay, I'm going to log into here, see if there's something about being audited that I need to pay attention to.
00:05:01
Speaker
Log in.
00:05:02
Speaker
There's nothing in there.
00:05:03
Speaker
I send an email to the IRS.
00:05:05
Speaker
I don't get any response back to verify that this was like an official document from them.
00:05:12
Speaker
So all things considered, I'm like, okay, there's no way that this is official.
00:05:15
Speaker
This is a scam.
00:05:16
Speaker
Tossing this in the trash.
00:05:18
Speaker
Don't have to worry about it.
00:05:19
Speaker
I'm good.
00:05:19
Speaker
I'm clean.
00:05:20
Speaker
Let's continue selling.
00:05:21
Speaker
And I thought I was good, but just my luck.
00:05:25
Speaker
I'm doing my thing.
00:05:25
Speaker
This is right as we're about to run a half marathon.
00:05:28
Speaker
So I'm logging a lot of miles running outside.
00:05:31
Speaker
One day during one of my long runs, it was like, I don't know, 10 mile run I was doing.
00:05:35
Speaker
I get a call from my wife.
00:05:36
Speaker
She says, hey, there's someone at the door from the IRS.
00:05:42
Speaker
Can you come back here?
00:05:43
Speaker
And I'm like, I'm like six miles from the house.
00:05:45
Speaker
I can't really come back.
00:05:47
Speaker
So you're gonna have to tell him to wait.
00:05:48
Speaker
And she's like, well, it looks pretty official.
00:05:51
Speaker
I don't know.
00:05:52
Speaker
You probably should hurry back here.
00:05:54
Speaker
And I'm like, okay, this is ridiculous.
00:05:57
Speaker
Now these scammers are so elaborate that they're literally showing up to my house.
00:06:01
Speaker
No way.
00:06:02
Speaker
So I told my wife, okay, we'll put me on the line with them.
00:06:05
Speaker
She passes this IRS representative the phone.
00:06:09
Speaker
And sure enough, it's Min on the same person that sent me the letter.
00:06:14
Speaker
And she says in her Vietnamese accent, but she tells me,
00:06:18
Speaker
Hey, I'm here at the house sitting at your table.
00:06:21
Speaker
We're here to go over your taxes.
00:06:22
Speaker
Where are you at?
00:06:23
Speaker
And I'm like, well, I'm running.
00:06:26
Speaker
I didn't know you were coming.
00:06:27
Speaker
She's like, well, did you not get my letter that said we're showing up that day?
00:06:30
Speaker
I go, yeah, but I thought it was a scam.
00:06:33
Speaker
I mean, it didn't seem very official.
00:06:35
Speaker
And she's like, no, well, this is my ID number.
00:06:38
Speaker
It's official.
00:06:39
Speaker
You're being audited.
00:06:40
Speaker
So we have an appointment.
00:06:42
Speaker
So long story short, I reschedule with her.
00:06:45
Speaker
And at this point, I'm like, okay, if they're showing up to my house, must be legit.
00:06:49
Speaker
Talk to my tax guys a little bit more and some other people.
00:06:52
Speaker
And sure enough, it's legit.
00:06:54
Speaker
Okay.
00:06:55
Speaker
I mean, at least to this point, it's legit.
00:06:57
Speaker
Maybe it is so elaborate that they're so deep in it now.
00:07:02
Speaker
And it's still not legit.
00:07:03
Speaker
But yeah.
00:07:04
Speaker
After verifying with my tax guys and getting more calls, having appointments, I'm pretty convinced now that it is legit.
00:07:12
Speaker
So if you get letters like that, definitely take them more serious than I did because this lady was not impressed.
00:07:19
Speaker
Luckily, she lets me reschedule.
00:07:22
Speaker
And we go back and forth.
00:07:26
Speaker
I was out of town for my half marathon.
00:07:29
Speaker
Another day, I had something else come up.
00:07:31
Speaker
So I had to reschedule a couple times, actually.
00:07:33
Speaker
But then by the time we finally get on the phone, she had sent me a long list of like 20 things I was supposed to get her.
00:07:40
Speaker
And we talked the first time.
00:07:41
Speaker
She's like, yeah, we'll just get as much as you can.
00:07:43
Speaker
Have your tax guys look for it, whatever you need to do.
00:07:46
Speaker
And so there's I'm looking at the list right now, but they're literally, I think.
00:07:52
Speaker
20 different, about 25 different items I was supposed to get her just of basically like all my expenses for 2020 and 2021.
00:08:00
Speaker
Bank statements, copies of prior audit reports, state employment tax returns, copies of 2020 forms, W-2, list of employees, all this, all this, all these shenanigans, right?
00:08:13
Speaker
A ton of stuff.
00:08:14
Speaker
So of course, I'm just like, forget about it.
00:08:16
Speaker
I'm not really going to.
00:08:17
Speaker
I'll get a couple of things.
00:08:18
Speaker
I'll send my tax guys.
00:08:20
Speaker
But I get on the phone with her and she's asking me for all this stuff.
00:08:25
Speaker
I'm like, I don't think I have very much.
00:08:27
Speaker
She starts grilling me.
00:08:28
Speaker
And this is where it gets real.
00:08:30
Speaker
And this is where she was not even impressed even more.
00:08:34
Speaker
We're going through all of it.
00:08:35
Speaker
She's asking me.
00:08:36
Speaker
I'm working on getting it to her.
00:08:38
Speaker
And then finally, I get my tax guys on the line.
00:08:41
Speaker
And keep in mind, 2020, I was using different tax people than I am right now.
00:08:46
Speaker
I'm using Pi Syndicate right now, which they have been great.
00:08:49
Speaker
They're sponsoring this show.
00:08:50
Speaker
And maybe this wouldn't happen if I use them back then.
00:08:53
Speaker
I don't think they're doing taxes.
00:08:55
Speaker
But I was using someone else.
00:08:57
Speaker
And what happened was I filed for this employee retention credit called the ERC.
00:09:05
Speaker
It was something they were doing during COVID.
00:09:07
Speaker
And I think I got around $10,000 for it.
00:09:09
Speaker
I heard about this from my tax guys at the time.
00:09:12
Speaker
And they're like, oh yeah, you should file all businesses, LLCs, S Corp.
00:09:17
Speaker
You can get it.
00:09:17
Speaker
So I'm like, all right, sweet, free money.
00:09:19
Speaker
They get it for me.
00:09:20
Speaker
And I don't know if it's something they did wrong.
00:09:22
Speaker
I'm not here to point fingers.
00:09:23
Speaker
But for whatever reason, the IRS is convinced that I should not have gotten this.
00:09:27
Speaker
So I get on the phone with Min.
00:09:29
Speaker
My tax people are on who filed this for me.
00:09:32
Speaker
And Min just starts grilling us.
00:09:34
Speaker
She's like, okay, well, first of all, you had to have employees to get this.
00:09:39
Speaker
Who was your employee?
00:09:40
Speaker
And my first answer was, oh,
00:09:43
Speaker
Hey, solarpreneurs.
00:09:43
Speaker
Are you sick and tired of spinning your wheels every month and not seeing your cells increase?
00:09:48
Speaker
Well, so was I. And the truth is I was never able to improve it until I figured out what was going wrong.
00:09:54
Speaker
So that's why I'm excited to announce for a limited time, we are doing a free cells diagnostic.
00:09:59
Speaker
You'll break down your cells process.
00:10:01
Speaker
to figure out the holes in your business and see how we can help you improve.
00:10:05
Speaker
So at now, we have six bucks for this month.
00:10:08
Speaker
So book a call now.
00:10:10
Speaker
Don't miss out.
00:10:11
Speaker
What you're going to do is send an email to taylor at solarpreneurs.com.
00:10:15
Speaker
That's taylor at solarpreneurs with an s dot com.
00:10:19
Speaker
I'll send you out a calendar link and we will figure out a time that works best.
00:10:23
Speaker
So shoot that email and let's increase your sales.
00:10:28
Speaker
I've never really had employees.
00:10:29
Speaker
I have a virtual assistant, but she's in the Philippines.
00:10:34
Speaker
So I don't list her as an employee because it gets all complicated with that.
00:10:38
Speaker
So I told her first, oh, I don't have employees.
00:10:40
Speaker
And then right off the bat, she's like, okay, what were you doing even filing for this?
00:10:44
Speaker
So I'm like, oh, shoot.
00:10:46
Speaker
Probably should tell her that I did have employees because that's why I was supposed to get this.
00:10:51
Speaker
So I remembered, and I'm not saying lie to your IRS representative, but what I didn't remember is that in 2020, I was having my wife actually...
00:11:00
Speaker
work in the business.
00:11:01
Speaker
She was helping me organize lists, organize my CRM, do customer follow-up, stuff like that.
00:11:07
Speaker
And so that is how I actually was able to qualify and get this ERC because I listed my wife as an employee in the business, but was not a good look when I told Min that I don't have an employee back then.
00:11:18
Speaker
Okay.
00:11:19
Speaker
So if you're being audited, make sure you remember what happened, why things were filed, what was going on,
00:11:25
Speaker
Remember that because it's a bad look and it's not doing me any favors by having to like try and remember all these things.
00:11:32
Speaker
So try to get your story straight.
00:11:33
Speaker
She probably thinks I'm just lying through my teeth at this point because I at 2020 I had no I couldn't remember a thing what happened in 2020, let alone last
Lessons Learned and Advice
00:11:42
Speaker
week.
00:11:42
Speaker
All right.
00:11:43
Speaker
So she's asking this.
00:11:44
Speaker
She's already suspicious.
00:11:45
Speaker
Then the second thing that gets me in trouble is she's like, OK, well, the other thing you're supposed to have COVID during this.
00:11:52
Speaker
So I need proof that you got COVID.
00:11:54
Speaker
I'm like, OK, I mean, I don't really have I didn't record when I got sick or anything.
00:12:00
Speaker
What what do you mean?
00:12:01
Speaker
She's like, well, send me your negative COVID tests.
00:12:03
Speaker
Send me anything you had.
00:12:05
Speaker
And I'm
00:12:06
Speaker
I didn't have anything.
00:12:07
Speaker
I don't have like negative COVID tests.
00:12:09
Speaker
I didn't have.
00:12:10
Speaker
Yeah, I did have the COVID symptoms.
00:12:12
Speaker
But to be honest, I didn't like I don't maybe I got tested back then.
00:12:15
Speaker
If I did, I did not save the test.
00:12:17
Speaker
I didn't save anything.
00:12:18
Speaker
I didn't go to the doctor.
00:12:19
Speaker
I'm not doing that.
00:12:20
Speaker
So she's saying she's like, look, in order to get this, you need to have some type of proof that you actually had COVID.
00:12:27
Speaker
So I didn't have any of that.
00:12:28
Speaker
And it blew my mind.
00:12:30
Speaker
These guys want proof of everything.
00:12:32
Speaker
So there's a lesson for you.
00:12:33
Speaker
Anything you file, anything that happens in the taxes, make sure you have proof of it.
00:12:37
Speaker
Obviously, it shouldn't be Nita said that you need to keep track of all your business expenses.
00:12:44
Speaker
That's another thing.
00:12:45
Speaker
We started going through that.
00:12:46
Speaker
She's asking me, hey, well, you listed $10,000 on...
00:12:51
Speaker
education for this year.
00:12:53
Speaker
What did you do?
00:12:53
Speaker
I'm like, I don't know.
00:12:55
Speaker
I just took a few courses, whatever.
00:12:57
Speaker
These people are ruthless.
00:12:59
Speaker
At least Min was.
00:13:00
Speaker
So make sure you know exactly how it's classified.
00:13:03
Speaker
And I do have another meeting with her.
00:13:05
Speaker
And the next time she wants like solid answers on everything.
00:13:09
Speaker
So that's actually what I'm going through right now.
00:13:11
Speaker
I have to go through every single expense, go back through my business expenses and figure all this out.
00:13:17
Speaker
So it's a very unpleasant experience.
00:13:19
Speaker
As you can probably tell, there's just so much to be done.
00:13:22
Speaker
And really just, I would say more than anything, my biggest lessons learned were probably a couple things there.
00:13:30
Speaker
Number one, just question things when you can get free money like that.
00:13:34
Speaker
I had a lot of friends that were getting this emergency retention credit.
00:13:37
Speaker
They made it sound super easy.
00:13:38
Speaker
My tax guys at the time made it sound super easy.
00:13:41
Speaker
But I wish I would have dug a little deeper, done some research into it instead of just saying, oh, yeah, send me my free money, whatever, because I knew nothing about it.
00:13:51
Speaker
And I'm just like, I don't know.
00:13:52
Speaker
My tax people did it.
00:13:53
Speaker
And that goes with taxes in general.
00:13:55
Speaker
Make sure you have some basic knowledge just about taxes in general.
00:13:59
Speaker
You don't need to be an expert, but a great book is
00:14:02
Speaker
that has helped me with I'm still not done reading it but everything I know about taxes really up to this point um good books called rich dad advisors tax-free wealth it's by Tom Wilray that was recommended by my friend Brady Slack who is a tax guy himself works with a lot of solar people but that's a great just a little fundamental book explains you you know a lot of the fundamentals of tax it goes pretty deep too
00:14:25
Speaker
So I'd recommend listening to that.
00:14:27
Speaker
Know your stuff, especially if you are getting audited or have to get on an appointment with an IRS agent.
00:14:33
Speaker
It's going to make you look a lot better if you actually know some of this stuff.
00:14:37
Speaker
Okay.
00:14:37
Speaker
And then the second thing is just keep detailed records of what you're actually doing.
00:14:43
Speaker
In 2020, when I wrote out all my business expenses and sent it in to my tax people, I just estimated on everything.
00:14:51
Speaker
Like, okay, tell me what you want to write off, put the amounts, and that's it.
00:14:55
Speaker
I'm just like, okay, well, I spent quite a bit in education this year.
00:14:58
Speaker
Let's put 10, 20 grand.
00:15:00
Speaker
Okay.
00:15:01
Speaker
Yeah, I spent quite a bit in vehicle expenses, but guess what?
00:15:05
Speaker
I didn't go out and actually calculate this.
00:15:07
Speaker
So, and it's coming back to bite me.
00:15:09
Speaker
So my first recommendation is use a bookkeeper if you can, because now with Pi Syndicate, they are doing my bookkeeping.
00:15:16
Speaker
Now I'm going to know exactly where the expenses are categorized and I can go into QuickBooks at any time and see all this.
00:15:22
Speaker
So I don't have to just guess on it like I was doing in 2020.
00:15:25
Speaker
So either use a bookkeeper or if you're not, just keep detailed records.
00:15:30
Speaker
Hey, you don't want to look like an idiot like me.
00:15:32
Speaker
So those are my biggest lessons learned.
00:15:34
Speaker
Number one, just question the free money.
00:15:36
Speaker
Learn more about what you're actually applying for.
00:15:39
Speaker
Keep detailed records and understand basic tax questions.
00:15:43
Speaker
And on top of that, these are some that I didn't necessarily think about as much, but I just did a little research into how to prevent tax audits.
00:15:53
Speaker
So I thought this may help a few of our listeners here.
00:15:55
Speaker
So here's a couple of good ones.
00:15:57
Speaker
It says, number one, don't report a loss.
00:15:59
Speaker
Seems like a good idea.
00:16:01
Speaker
Don't report a loss in your business.
00:16:03
Speaker
Always report a little profit.
00:16:04
Speaker
Number two, be specific about expenses, which I did not.
00:16:08
Speaker
I was not specific about expenses.
00:16:09
Speaker
Number three, provide more detail when needed.
00:16:12
Speaker
Yeah, so just make sure you keep your detailed records about what's going on.
00:16:16
Speaker
Number four, be on time.
00:16:18
Speaker
So yeah, if you're the type of person that's always filing an extension, that's always waiting until the last second to do their taxes, maybe consider getting them in early.
00:16:26
Speaker
Apparently, it's less likely to get flagged for an audit.
00:16:29
Speaker
And they've had so many new IRS agents hired.
00:16:32
Speaker
I probably wouldn't have got audited if all these new freaking IRS agents weren't brought on board.
00:16:37
Speaker
So thanks a lot, Biden.
00:16:38
Speaker
But it is what it is.
00:16:39
Speaker
And then number five, avoid amending returns.
00:16:43
Speaker
Number six, match up all your paperwork.
00:16:45
Speaker
Number seven, don't use the same numbers repeatedly, which that's what I was doing back a couple years ago.
00:16:51
Speaker
It was always the same write-offs, always the same numbers.
00:16:53
Speaker
Number eight, don't take excessive deductions.
00:16:56
Speaker
Just not overestimating the extent of your donations or excessive home office deductions, excessive deductions for meals, travel, etc.
00:17:04
Speaker
Number 10, don't leave questions blank.
00:17:07
Speaker
Number nine, sorry, skip that.
00:17:09
Speaker
Use Schedule C, which asks your tax people if you don't know what that is.
00:17:12
Speaker
So anyways, hope that helps some of you to not get audited.
00:17:15
Speaker
That was my experience.
00:17:16
Speaker
It sucks.
00:17:17
Speaker
Don't do what I did.
00:17:19
Speaker
Hope you can avoid all of the men's in your life.
00:17:21
Speaker
Men, if you're listening to this for some reason, I love you, but please don't audit me again.
00:17:26
Speaker
Okay, so that's
